Terms of Service

These Terms of Service ("Terms") are an agreement between you and JUAN SANSON, JR ("we", "us", "our"), which runs TodaysHooks at https://todayshooks.com (the "Service"). By starting a trial, signing in, or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. What the Service is

TodaysHooks provides daily packs of short-form video ideas for a profession (a "niche"): hooks, a script outline, a caption, hashtags, and a comment prompt. Packs are generated with artificial intelligence. They are ideas and drafts for you to review, edit, and use at your own judgment. See the AI Content Disclaimer.

2. Who can use it

The Service is for people aged 18 or older who use it for their own business or professional activities. You must be able to form a binding contract where you live. If you use the Service for a company, you confirm you can bind that company, and "you" includes it.

3. Your account

You sign in with a single-use link sent to your email, so you are responsible for keeping that email account secure. Keep your account details accurate. Do not share your account or sign-in links, or let others use your login. Tell us promptly if you think someone else has access. We may limit or suspend access we reasonably believe is shared or compromised.

4. Plans, free trial, and automatic renewal

• Prices. The standard plan costs $19 per month or $190 per year. A limited number of founding-member spots cost $12 per month, and that price stays in place for as long as that subscription continues without lapsing. Prices are shown in US dollars and exclude any applicable sales tax or similar taxes, which are added at checkout where required.
• Free trial. New customers get a 3-day free trial. A payment card is required to start it. One free trial per customer. If we detect a repeat trial (for example the same card used on another account), the trial may end immediately and your first charge may apply right away. During the trial you can see today's pack and the previous 7 days of your niche's archive.
• Automatic renewal. When the trial ends, your plan starts and your card is charged. It then renews automatically each month or year, at the price in effect for your plan, until you cancel. We email you a reminder before your trial ends.
• Extra niches. Once your trial has ended and your plan is active, you can add up to 2 extra niches for $9 per month ($90 per year on the annual plan). When you add one, you are charged right away for the remainder of your current billing period, and the full amount renews with your plan. If you remove an extra niche, the unused part is credited toward your next invoice.
• Changing niches. You can change any of your niches once every 30 days. Your archive follows the niches you currently hold.
• Price changes. We may change prices. We will email you at least 30 days before a change takes effect for your plan, and it applies from your next renewal after that. You can cancel before then.
• Payment. Payments are processed by Stripe. Your purchase is made through Stripe's Managed Payments service: Stripe, through its Link checkout, is the seller of record for the transaction. It calculates, collects and remits sales tax, VAT or GST where required, sends your receipts and invoices, and handles payment and billing support. The charge on your card statement appears as LINK.COM followed by our name. We provide the service itself: the packs, archive and your account. If a payment fails, we or Stripe may retry it, and we may suspend access until it succeeds.

5. Cancelling and refunds

You can cancel at any time from your account page. If you cancel, your plan stays active until the end of the period you already paid for and then does not renew. The Refund and Cancellation Policy explains refunds, including the 7-day refund after any charge, and forms part of these Terms.

6. Your license to the content

We own the Service, including its software, design, niche descriptions, and the archive as a collection. While your subscription is active, we give you a personal, non-exclusive, non-transferable, revocable license to use the hooks, scripts, captions, hashtags, and prompts from packs you can access in your own business and on your own social media accounts and marketing. After you cancel, content you already posted can stay up.

You may not: resell, sublicense, publish, or distribute packs or the archive to others; use them to build or train a competing service or dataset; copy the archive in bulk or use bots or scrapers to collect it; or share your login so others can read it.

Because packs are AI-generated for a niche, other subscribers in the same niche may receive similar or overlapping ideas, and we do not promise any content is unique or exclusive to you. AI-generated material may not qualify for copyright protection in some places, and we do not promise you will hold exclusive rights in it.

7. Your information and feedback

You keep ownership of the business details you save in your profile. You give us permission to use them to run the Service for you. If you give feedback (including thumbs up, thumbs down, and copy actions, or suggestions), you give us permission to use it, in combined and de-identified form, to improve the Service without owing you anything. See the Privacy Policy.

8. Requesting new niches

You can ask us to add a profession that is not listed. We review requests by hand and may approve, merge, or decline any request in our discretion, including categories we do not offer because of the claims or regulations involved. We do not promise any niche will be added or kept available. If we decline your request, the refund terms in the Refund Policy apply.

9. Acceptable use

You agree to follow the Acceptable Use Policy. We can suspend or end access if you do not.

10. You are responsible for what you post

You decide what to film and publish. You are responsible for reviewing every hook and script, making sure it is true and fits your business, and following the law and the rules of each platform you post on. That includes advertising and endorsement rules (for example disclosing paid partnerships), consumer protection laws, licensing rules for your profession, and platform community guidelines. We give no legal, medical, financial, or professional advice.

11. Other platforms

TikTok, Instagram, YouTube and other platform names are trademarks of their owners. We are not affiliated with, endorsed by, or sponsored by them. We do not control those platforms and are not responsible for how they treat your account or content.

12. Availability and changes to the Service

We aim to publish packs every morning but do not guarantee the Service will be uninterrupted, error-free, or that a pack will be available every day. We may change, pause, or discontinue features or niches. If we discontinue the Service entirely, we will refund the unused part of any period you have paid for.

13. Suspension and termination

We may suspend or end your access immediately if you break these Terms, create risk or legal exposure for us or others, or misuse the Service. If we end your account for a reason other than your breach, we will refund the unused part of the period you paid for. You may stop using the Service and cancel at any time. Sections that by their nature should survive (such as license limits, disclaimers, liability limits, and governing law) survive termination.

14. Disclaimers

The Service and all content are provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, non-infringement, and any warranty that content will be suitable for you or will produce views, followers, customers, bookings, sales, or income. AI-generated content can be wrong, repetitive, or inappropriate, and you use it at your own risk.

15. Limit on our liability

To the fullest extent the law allows: (a) we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, customers, goodwill, or data, even if told they were possible; and (b) our total liability for all claims about the Service is limited to the amount you paid us in the 12 months before the event that gave rise to the claim, or $100 if you paid nothing. Some places do not allow certain limits, so parts of this section may not apply to you, and nothing here limits liability that cannot be limited by law or affects rights you have as a consumer under mandatory local law.

16. Indemnity

You agree to defend and reimburse us, our owners, and our service providers for claims, losses, and costs (including reasonable legal fees) that come from content you create or publish using the Service, your breach of these Terms, or your violation of law or someone else's rights. We will tell you about any claim promptly and let you help with the defense where that is practical.

17. Governing law and disputes

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Before filing a claim, you agree to contact us at support@todayshooks.com and give us 30 days to try to resolve the issue informally. Any dispute that is not resolved will be brought in the state or federal courts located in Thurston County, Washington, and you and we agree to their jurisdiction, except that either of us may go to small claims court where it applies, and consumer protection rights that cannot be waived under the law where you live are not affected.

18. Changes to these Terms

We may update these Terms. For material changes we will give notice by email or on the Service before they take effect. If you keep using the Service after the effective date, you accept the updated Terms. If you do not accept them, cancel before the effective date. The version in force is shown at the top of this page.

19. General

These Terms, together with the policies they link to, are the whole agreement between us about the Service. If a provision is found unenforceable, the rest stays in force. Not enforcing a provision is not a waiver of it. You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a sale or reorganization. Neither of us is liable for delays caused by events beyond reasonable control. You agree we can send you notices and legal communications electronically, including by email.
